Waiver, Release of Liability, Indemnification, and Consent to Medical Attention

 
In exchange for my being allowed to participate in the Veteran Impact Services, Inc. Dba Operation Charlie Bravo 2025 Bivouac Ride ("Activity"), a Get Lost Outdoor Program Activity conducted by Operation Charlie Bravo, I, the individual identified below and signing this document, agree to be bound by each of the following: 

1. Description of Activity.  The Activity features Veterans and/or Volunteers within Operation Charlie Bravo that may participate in a motorcycle/car or other vehicle multiple day ride starting in Crown Point in the State of Indiana, traveling by motorcycle or other means through the states of Ohio, Pennsylvania, New York, Vermont, Massachusetts, and ending in Crown Point in the State of Indiana. There, the Activity may include outdoor camping, food, entertainment, excursions, and other related activities.

2. Voluntary Involvement.  I understand and confirm that my involvement in the Activity (as a "Volunteer") and/or my participation in the Activity (as a "Participant") is voluntary. I will cover any related expenses not voluntarily covered by Operation Charlie Bravo such as food, lodging, gas, etc.

3. Identification and Assumption of Risks.  I understand that serious accidents may occur during the Activity (which includes all related travel) and that Volunteers and Participants may sustain serious personal injuries, as well as property damage, as a consequence thereof.  I understand these risks and know that my actions in the Activity as a Volunteer and/or a Participant, may involve risk of such personal injuries and property damage, including the possibility of permanent disability and death.  I understand that this Waiver and Release of Liability is intended to address all of the risks of any kind associated with my actions as a Volunteer and/or a Participant in any aspect of the Activity, including, particularly, such risks created by actions, inactions, carelessness, or negligence on the part of the Operation Charlie Bravo or its directors, officers, employees, agents, volunteers, successors, assigns, or persons acting under its permission or authority.  I assume all risks, known and unknown, foreseeable and unforeseeable, in any way connected with my actions as a Volunteer and/or a Participant in the Activity. I certify that I am physically fit, have sufficiently prepared or trained for participation in the Activity, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this Activity.

4. Release and Waiver.  I release Operation Charlie Bravo and all affiliated entities of the 2025 Bivouac Ride, and all Activity organizers, sponsors and advertisers (collectively, the "Indemnified Corporations and Individuals"), and their respective directors, trustees, officers, employees, agents, volunteers, successors, assigns, related entities, and all persons acting under their permission or authority from any and all liability for, and waive any and all claims for, injury, loss, damage, or expense, including attorneys' fees, in any way connected with my actions in the Activity as a Volunteer and/or a Participant (“Claim(s)”), whether or not caused in whole or in part by the negligence or other misconduct of the Indemnified Corporations and Individuals, or any volunteer or participant in the Activity. 

5. Indemnification.  I agree to indemnify and to hold harmless (in other words, to reimburse and to be responsible for) the Indemnified Corporations and Individuals and their directors, trustees, officers, employees, agents, volunteers, successors, assigns, and all persons acting under their permission or authority from all Claims (including the cost of defending any Claim I might make, or that might be made on my behalf, that is released or waived by this instrument) in any way connected with or arising out of my actions as a Volunteer and/or a Participant in the Activity (including Claims relating to my actions while under the influence of alcohol or any other substance served or made available in connection with the Activity), whether or not caused in whole or in part by the negligence or other misconduct of the Indemnified Corporations and Individuals, or their directors, trustees, officers, employees, agents, volunteers, successors, assigns, and all persons acting under their permission or authority, and any other volunteer or participant in the Activity. I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING AND/OR VOLUNTEERING IN THIS ACTIVITY, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.
 
6. Binding Effect.  This instrument shall be binding upon my relatives, personal representatives, heirs, beneficiaries, next of kin, or assigns. 

7. Insurance. I understand that it is in my best interest, and that Operation Charlie Bravo and the 2025 Bivouac Ride encourages me, to have personal accident and medical insurance coverage to cover risks associated with my actions as a Volunteer and/or a Participant in the Activity. 

8. Applicable Law.  This instrument shall be governed, construed, and enforced in accordance with the law of the State of Indiana, the State of Indiana, Ohio, Pennsylvania, New York, Vermont, and Massachusetts

9. Minor Participant. If an individual(s) under 18 is accompanying me in the Activity, the undersigned agrees that as the parent or legal guardian of said minor individual(s), I, and my spouse or co-legal guardian, verify that I, and my spouse or co-legal guardian, fully understand, agree to, and accept all provisions of this Agreement also on behalf of said minor(s). If I am not the legal guardian, I agree to indemnify Indemnified Corporations and Individuals for any and all claim(s) brought by or on behalf of said minor(s).

10. Consent to Photography. I understand that any photographs and/or videos taken with my liking may be posted and or used on social media and/or the Operation Charlie Bravo website and/or additional marketing tools/platforms for promotional purposes. 

THIS IS A WAIVER AND RELEASE OF LIABILITY, INDEMNIFICATION, AND CONSENT TO MEDICAL ATTENTION.  I HAVE READ THIS WAIVER, RELEASE OF LIABILITY, INDEMNIFICATION, AND CONSENT TO MEDICAL ATTENTION.  I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT.  I AM SIGNING THIS WAIVER, RELEASE OF LIABILITY, INDEMNIFICATION, AND CONSENT TO MEDICAL ATTENTION VOLUNTARILY ON BEHALF OF MYSELF AND ANY MINOR(S) ACCOMPANYING ME.
